Fund Collection and Refunds

imagesbylloyd.com/ EW Specialized Services LLC, billing under a third party charging company, will collect funds at times, including advance funds for deposits for bookings, retainers for the convenience of last minute appointments, membership fees, and gifts/ tips photoshoots. These funds become a part of the trust fund of the company, and are non-refundable. imagesbylloyd.com / EW Specialized Services LLC does not refund fees or deposits at any point, once received.

Funds are held in trust and may be used against a future booking, or used for the appointment originally intended. Funds not utilized (*with no contact) within 6 months are distributed as usual between the company, and the companion for whom the funds were originally secured. We will always attempt to contact an individual with un-used credit several times in the last month. The company does not hold funds against a client’s will, subject to international security, acts of God and natural disasters; if he wishes to use the funds to pay for time with an session, within 6 months* of the time the funds first arrived in the company account, then he/she is authorized to do so.

*This is subject to the client responding to contact. The company will always let the client know his funds are held in credit, and he is required to respond to acknowledge that, thereby laying claim to the funds in response in writing. Any contact will extend his credit security a further 6 months. If he does not respond (effectively agreeing with the 6 month agreement ) within 48 hours, the funds will be held for 1 month from the date of transfer/ from the last point of contact, as a gesture of good faith. If the company has not heard from him since transfer, or during this last month of the six-month grace period, then the funds will be distributed as usual, and he/she will forfeit the funds.

Funds are often held for years for our clients. As long as regular contact is made/ contact from the agency is responded to, grace period are ongoing and perpetual. We have no interest in misappropriating a client’s funds, however stagnant funds need to be used or shared with the model for whom they were intended, in order to balance our accounts for taxation purposes.

During unprecedented or unexpected situations, such as civil war, global pandemics or other such unlikely scenarios, all agreements are frozen and reinstated at the time the company re-opens. Thereby no loss of grace period will occur; that time period will be as if it never existed, and funds will be retained as of the date before the unexpected situation occurred, with all the best efforts of the company, subject to security and ability to do so.

You agree, by using this site, that your use of this site is at your sole risk, that you assume full responsibility for all loss, including loss of pre-paid funds or deposits through your non-contact or non-response.

Violation of the terms of agreement for fund deposits and membership funding will see all funds forfeited and permanent dismissal as a client from the company.

Booking Fees Refunds

imagesbylloyd.com / EW Specialized Services LLC will collect a 50% booking fee for every single booking, If for some reason the Client fails to show or cancels within 48/24 hours before or is a no show, The deposit will be forfeited

Limitation of Liability

In no event shall imagesbylloyd.com / EW Specialized Services LLC be liable for any actual, direct, indirect, special, punitive, incidental, exemplary or consequential damages, or any other damages whatsoever, even if imagesbylloyd.com / EW Specialized Services LLC has been previously advised of the possibility of such damages, whether in an action under contract, tort or under any other theory, arising out of or in connection with the use, inability to use, or performance of the information, services, and materials on this site.

You agree to defend, indemnify and hold harmless imagesbylloyd.com/ EW Specialized Services LLC, its affiliates or subsidiaries, and their officers, directors, employees and shareholders from and against any and all claims, damages, losses, costs and expenses, including, but not limited to, reasonable attorneys’ fees and court costs, arising from or related to your use of this website or the service itself.
